Equal Justice

One of these men was sentenced to 1 year in prison for firing a weapon three times (LJS mobile link) to break up a fight, wounding two friends in the process. I'll let you guess which man got which sentence, or you can follow the links to find out for yourself.

I guess I have to ask.. what point are you trying to make?  What previous trouble has each person been in?  Did they both plead guilty or did they fight the arrest?  Were there other mitigating factions to each case?

I guess I’m kind of surprised to see this here on the blog.

I admit I’m taking a bit of a risk by doing so, but I’m trusting that Lori Pilger would have included relevant information like criminal history if it were applicable in either case. (Lori Pilger wrote both articles.) She didn’t mention it in either story, either via her own research or in the context of courtroom discussions. Thus, I have to assume that (a) neither man has a criminal background, or (b) the background they do have wasn’t considered relevant to the court’s sentencing.

As for why I brought this up here, occasionally I stir things up a bit. Sometimes I do it to make a point, other times I do it just to see what folks’ reactions are, and now and then I do it for no good reason at all. The topic is always relevant to me somehow—a personal interest, a morbid curiosity, a life mission. This topic happens to hit on a few levels: it’s local; it deals with criminal justice (an interest of mine); and I happen to have 1.5 white boys and 1.5 black boys at home.

I just read both stories again (thanks for the mobile links).

The only 2 things that I noticed were that they were sentenced by 2 different judges, and that one was using a stolen gun.

Not sure if or why either of those make a difference. I was most curious if one judge made the two rulings in short proximity to each other. I suppose 2 judges could have different feelings on the issue.

I have no idea if the fact the gun was stolen has anything to do with anything.

Even though both crimes look the same, they aren’t.  I’m all for stirring the pot (heck I’m doing it by posting) but I like the facts and not just what a journalist (because they never exclude information that may be important).

According to the Lancaster County records, Buay Keak was charged with 3 things, 2 of those were dismissed and what he was being sentenced for was Possession of a defaced fiream.  He got 2-4 years for that (with 201 days credit).

1/5/2012   Terroristic Threats   06/27/2012 Dismissed By Prosecutor
1/5/2012   Use of a Firearm to Commit a Felony   06/27/2012 Dismissed By Prosecutor
1/5/2012   Possess a Defaced Firearm   08/02/2012 2 Year(s) to 4 Year(s) Dept. of Correctional Services   Merritt, Jr., Paul D.

Alen Sljivo was originall charged with 2 things, one of them dismissed.

10/15/2011   Terroristic Threats   05/22/2012 365 Day(s) Lancaster County Jail   Nelson , Jodi L.
10/15/2011   Assault, 2nd degree   04/05/2012 Dismissed By Prosecutor

So, he got 1-2 years for Terroristic Threads.

We don’t know why certain charges were dismissed for one and not the other.  We don’t even know if they worked out a plea bargain of sorts to get some of those charges dismissed.  All we know is that it appears that you can get more time for having an defaced firearm then you can when you accidently shooting 2 people.

Oh, it’s also interesting to note that the man who got 2-4 years was also charged (and it was dismissed) with this..
1/19/2012   Assault by a Confined Person   06/27/2012 Dismissed By Prosecutor

How did that factor into how many years he got…

I’m willing to bet they both have criminal backgrounds and got less time than they should have received. Why are these young people carrying around guns to “parties”. Lucky they aren’t up for manslaughter or murder. Not the kind of “parties” I would like to attend. They should ask a man named Lucky what happens when you feel the need to take firearms to “parties”. Idiots
