Acting Unreasonably

As I predicted, Lincoln will have to pay over $330,000 thanks to Mayor Seng's veto of a change to group home zoning restrictions. In his decision, U.S. District Judge Richard Kopf cited "heaps of red tape … and inconsistent and irrelevant posturing by city officials, elected and otherwise". He added that "by merely acting reasonably, Lincoln could have easily avoided that expensive outcome." That's probably not the send-off Colleen Seng was hoping for in her last weeks as Mayor. Since Seng is on her way out the door, I won't bother further denouncing her veto decision. However, if you are in the mood to let off some steam, go right ahead.

What a disaster her term as mayor has been. While I normally don’t subscribe to kicking someone when they are down, she deserves everything that’s coming to her. I hope the administration of Chris Beutler, Democrat, can follow through on his promises to restore some order to that office. And can we please get an auditer? Thanks. Oh yeah, and Ken? I’d dump the city contract if they don’t dump you first, and not apply again. Thanks for playing.

According to the original article, Mayor Seng believes that the city’s ban on more than three unrelated people living together should apply equally to disabled and non-disabled persons. IMO that isn’t an inherently unreasonable position to take, and I admire Seng’s belief in local zoning control. Except that it ignores the fact that the Feds don’t agree. To me, this outcome was obvious. Seng should have listened to her legal team.

I still think they just should have just upped the # of unrelated people living together, disabled or not. How often can that possibly be enforced?
